When a standard has been commissioned by the European Commission, its reference is published in the Official Journal of the EU following the standard's publication. As soon as this has taken place, the standard gives rise to the "presumption of conformity". This results in the burden of proof being reversed: a manufacturer who manufactures his product in compliance with a harmonized standard may assume that the product satisfies the requirements of the underlying directive that are covered by the standard. Where necessary, the onus lies upon the market surveillance authorities to prove otherwise.
